( Norris v. Alabama ) On 1 April 1935, the Supreme Court ruled (8–0) that the F ourteenth A mendment's due process clause obliged state courts to uphold the S ixth A mendment's guarantee that defendants in capital cases be tried by an impartial jury. In a retrial of the first S cottsboro case , it overturned the defendants' conviction because blacks were excluded from the jury deciding the case, and because extreme racial prejudice dominated the court atmosphere. ... log in or subscribe to read full text
