This is the prerogative of US presidents to keep their official documents confidential and decline to give testimony. George W ashington first claimed this right when turning down a request by the House of Representatives (24 March 1794) to see papers relating to J ay's T reaty . Thomas J efferson cited the principle in 1807 when refusing a subpoena from John M arshall to appear as a witness and furnish certain papers at Aaron B urr's treason trial. In United States v. Nixon (24 July 1974), the Supreme Court ruled that executive privilege could not be invoked to avoid complying with subpoenas for evidence needed in criminal trials. ... log in or subscribe to read full text
